The court will only grant you a divorce if your marriage has ‘irretrievably broken down’, meaning that one or more of the following grounds exists:

Adultery by one of the parties to the marriage.

Unreasonable behaviour by one of the parties to the marriage.

Desertion for a period of at least two years.

If you both agree to the divorce, two years separation is a ground.

If your husband or wife won't agree to the divorce then five years separation is a ground.
